BMV Terms of Service

The website at bmv-vet.com (the “Site”) is owned/operated by BMV and its subsidiaries (collectively, “BMV PETKITS”, “us”, “our”, “we”). The Site includes related blogs, mobile sites, and apps. Additional guidelines for specific Site features are incorporated into these Terms.

These Terms govern your use of the Site. By accessing/using the Site, you confirm you are at least 18 years old and agree to these Terms. If you disagree, do not use the Site.

Key Dispute Provision: You may only pursue disputes against us individually (no class actions) and waive the right to a jury trial or court litigation (see Section 13.2).

1. Accounts & Purchases

1.1 Account Creation: To use some features, register an Account with truthful, accurate information. You may delete your Account; we may suspend/terminate it per Section 11.

1.2 Account Responsibility: Keep login info confidential. Notify us immediately of unauthorized use—we are not liable for losses from your failure to do so.

1.3 Purchases: Provide complete, accurate info for purchases (whether via Account or guest checkout). Update Account details (e.g., email, payment info) to ensure smooth transactions.

1.4 Personal Info: Governed by our Privacy Policy (available at bmv-vet.com).

2. Site Access & Ownership

2.1 License: We grant you a non-transferable, limited license to use the Site for personal, non-commercial purposes.

2.2 Restrictions: You may not: (a) sell/rent/modify the Site or its content; (b) reverse-engineer or copy Site code; (c) use the Site to build a competitive product; (d) remove proprietary notices.

2.3 Modifications: We may modify/suspend/discontinue the Site (in part or full) without notice—we are not liable for this.

2.4 No Support: We have no obligation to provide support/maintenance for the Site.

2.5 Intellectual Property: All Site content (excluding your User Content) is owned by BMV —no rights transfer to you except the limited license in 2.1.

2.6 Feedback: Any feedback you provide is non-confidential; we may use it freely, and you assign all rights to us.

3. Optional Services

3.1 Subscriptions:

• Auto-billed monthly via your payment method.
• Renews automatically unless canceled before the next billing cycle.
• Cancellations end service at the end of the paid period (no refunds for the current cycle).
• Additional subscription terms (if posted) supersede conflicting Terms.3.2 Third-Party Tools: We provide access “as-is” with no warranties—use at your own risk. We are not liable for third-party tool issues.3.3 New Services: Future Site features/services are subject to these Terms.

4. Return Policy

4.1 Eligibility: Return eligible products within 30 days of delivery (original packaging, unused).

4.2 Return Authorization: Contact support for an RA Number—returns without one are rejected.

4.3 Fees & Shipping:

• Opened non-defective products: Final sale (no returns).
• Unopened non-defective products: 15% restocking fee.
• You cover return shipping costs.4.4 Defective Products: Return for verification—we replace with the same model (or comparable/refund if unavailable).4.5 Product-Specific Rules: Check individual product pages for unique return terms (supersede general policy).

5. User Content

5.1 Your Responsibility: You own User Content (e.g., profile posts) and assume all risks (e.g., privacy, accuracy). We do not back up User Content—you must save copies.

5.2 License to Us: You grant us a worldwide, royalty-free license to use/reproduce your User Content for Site purposes.

5.3 Acceptable Use: Do not post content that is unlawful, infringing, harmful, or spam. Do not hack the Site, harvest user data, or send viruses.

5.4 Enforcement: We may remove User Content, terminate your Account, or report you to authorities if you violate this policy.

6. Products & Orders

6.1 Availability: Online-only products may have limited stock. Product colors/images may vary from real life.

6.2 Sales Limits: We may limit sales by person/region or discontinue products without notice.

6.3 Order Refusal/Cancellation: We may refuse/cancel orders (e.g., duplicate orders) and notify you if possible.

6.4 Errors: We may correct pricing/availability errors and cancel orders if info is inaccurate—no obligation to update Site info.

8. Third-Party Links & Users

8.1 Third-Party Links: The Site may link to external sites—we do not control/endorse them. Use at your own risk; third-party terms apply.

8.2 Other Users: We are not responsible for other users’ content or your interactions with them.

8.3 Release: You release us from claims related to the Site, other users, or third-party links (including California Civil Code §1542 waiver).

9. Disclaimers

The Site and its products/services are provided “as-is”/“as-available”. We disclaim all warranties (express/implied), including merchantability, fitness for purpose, or error-free use. If required by law, implied warranties last 90 days.

10. Liability Limitation

To the maximum extent allowed by law:

• We are not liable for personal injury, lost profits, or indirect/consequential damages from Site use.
• Our total liability for any claim is limited to the product purchase price (or $5 if no product is involved).

11. Term & Termination

These Terms apply while you use the Site. We may terminate/suspend your Account/Site access at any time (for violations, etc.). Upon termination, your Account is deleted (including User Content). Post-termination, Sections 2.2–2.6, 4–13 remain in effect.

12. Copyright Policy

We respect copyrights. To report infringement, send a written notice to our Copyright Agent (details to be posted on bmv-vet.com) with: your signature, infringing material ID, contact info, and a good-faith belief of infringement. Misrepresentations may lead to liability.

13. General Terms

13.1 Changes: We may revise these Terms—we’ll notify you via email/Site post. Continued use means you accept changes.

13.2 Governing Law: California law applies. Disputes are resolved individually (no class actions), and you waive jury trials. Venue is San Francisco County, CA.

13.3 Export: Comply with U.S. export laws—do not transfer Site data in violation of regulations.
